These Terms & Conditions ("Terms") govern your use of the website smartpixelai.com and the services provided by SmartPixel AI ("SmartPixel", "we", "us"), a digital services studio located at DLF Cyber City 87, Chandaka Industrial Estate, Patia, Bhubaneswar, Odisha 751024, India. By using this website or engaging our services, you agree to these Terms. If you do not agree, please do not use the website or our services.
2. Our services
SmartPixel provides digital marketing and technology services, including social media marketing, AI video creation, SEO content writing, web and application development, and AI phone and voice agent solutions. The specific scope, deliverables, timelines and fees for any engagement are defined in the quote, proposal or service agreement shared with you before work begins. In case of any conflict between these Terms and a signed service agreement, the service agreement prevails.
3. Quotes, fees and payment
- Prices displayed on the website (such as monthly plans) are indicative starting prices and may be confirmed or adjusted in your individual quote.
- Unless stated otherwise, monthly plans are billed in advance and one-time setup fees are payable before work begins.
- Usage-based charges (such as AI agent conversation minutes beyond a plan's included allowance) are billed as described on the relevant service page or in your quote.
- Late or failed payments may result in suspension of services until payment is received.
4. Free demo video
Our free demo video offer is limited to one demo per business, is provided at our discretion, and carries no obligation on either side. Demo videos are provided for evaluation purposes; commercial usage rights to demo material are granted only upon commencement of a paid engagement, unless we agree otherwise in writing.
5. Client responsibilities
- You confirm that any content, materials, logos, scripts or briefs you provide to us do not infringe any third party's rights and that you have the authority to use them.
- You are responsible for the accuracy of business information you provide (such as prices, claims and offers) that we incorporate into content, websites or AI agents on your behalf.
- You will provide timely feedback and approvals; delays in approvals may extend delivery timelines.
6. Intellectual property
Upon full payment, you own the final deliverables produced for you — including videos, articles, designs, websites and configured AI agents — for your commercial use. We retain ownership of our internal tools, templates, know-how and processes used to produce the deliverables. We may showcase non-confidential work in our portfolio unless you request otherwise in writing.
7. AI-generated content
Some deliverables are produced with the assistance of artificial intelligence tools. We apply human direction, editing and quality review to all AI-assisted work. You acknowledge that AI-generated output may have limitations, and that platform policies of third-party AI providers may affect the availability of certain styles or features over time.
8. No performance guarantees
Digital marketing results depend on many factors outside any agency's control. While we describe our past results honestly and work to achieve the best outcome for every client, we do not guarantee specific views, followers, rankings, traffic, leads or revenue. Any figures on this website describe past performance and are not promises of future results.
9. Third-party platforms
Our services rely on third-party platforms such as social media networks, search engines, hosting providers, telephony providers and AI service providers. We are not responsible for changes, outages, policy decisions or account actions taken by these platforms, though we will always work with you in good faith to adapt to such changes.
10. Cancellation
Unless your service agreement states otherwise, monthly services can be cancelled with notice before the next billing cycle; amounts already paid for the current cycle and completed work are not refundable. One-time project fees for work already performed are not refundable. Specific cancellation and refund terms for your engagement are stated in your quote or service agreement.
11. Limitation of liability
To the maximum extent permitted by law, SmartPixel's total liability arising out of or related to any engagement is limited to the fees paid by you for the specific service giving rise to the claim during the three (3) months preceding the claim. We are not liable for indirect, incidental or consequential losses, including lost profits or lost business opportunities.
12. Website use
You agree not to misuse this website — including attempting to disrupt it, scraping it at scale, abusing the AI voice assistant, or submitting false or malicious information through our forms or agent.
13. Governing law
These Terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the courts of Bhubaneswar, Odisha.
14. Changes to these terms
We may update these Terms from time to time. The current version will always be available on this page with its effective date. Continued use of the website or services after changes means you accept the updated Terms.
